Welcome to Kre8 Social — where refined design meets measurable growth.
Kre8 Social, LLC ("Kre8 Social," "we," "us," or "our") partners with real estate professionals and local small businesses to deliver human-crafted branding, content, websites, and done-for-you lead generation through our membership plans and à la carte services. These Terms of Service and the accompanying Privacy Policy (together, the "Terms") govern your access to and use of our website, products, and services (collectively, the "Services").
Please read these Terms carefully. By accessing our website, purchasing a membership or service, or otherwise engaging Kre8 Social, you ("you," "your," or "Client") agree to be bound by these Terms. If you do not agree, do not use the Services. These Terms include a binding arbitration provision and a class-action waiver (Section 31) that affect your legal rights.
PART I — TERMS OF SERVICE
1. Agreement to Terms
These Terms constitute a legally binding agreement between you and Kre8 Social. They apply to all visitors, users, and clients of the Services. Any order form, proposal, invoice, statement of work, or checkout confirmation you accept is incorporated into and governed by these Terms. In the event of a conflict between a signed statement of work and these Terms, the signed statement of work controls for that engagement only.
2. Definitions
"Membership" means a recurring, subscription-based plan. "Add-On" means an optional service purchased alongside a Membership. "À La Carte Service" means a one-time or project-based service purchased outside a Membership. "Deliverables" means the designs, content, graphics, websites, funnels, and other work product Kre8 Social creates for you. "Client Materials" means logos, photographs, text, trademarks, credentials, data, and other materials you provide. "Platform" means any third-party service (e.g., Meta, Google, TikTok, YouTube, Wix, Canva, payment processors, email/SMS providers).
3. Eligibility & Authority
You must be at least eighteen (18) years old and capable of forming a binding contract to use the Services. If you engage Kre8 Social on behalf of a business or other entity, you represent and warrant that you are authorized to bind that entity to these Terms, and "you" refers to that entity.
4. Our Services
Kre8 Social offers monthly Memberships across two program families — one for real estate agents, teams, and brokerages, and one for local small businesses in any industry — as well as Add-Ons and À La Carte Services including branded social content, print and digital design, websites, landing pages and funnels, lead magnets, email and SMS marketing, reputation and local-search support, and paid advertising management. Plan tiers, inclusions, quantities, and platforms are described on our Pricing pages and may vary by plan. We reserve the right to modify, add, or discontinue any Service or feature at any time.
5. Membership Plans, Setup Fees & Billing Authorization
Memberships are billed in advance on a recurring monthly basis (or annually where offered). Most plans require a one-time brand and/or funnel setup fee, disclosed at checkout, to build and launch your system. Deliverables, quantities, and platforms vary by plan as shown on the applicable Pricing page.
Recurring Billing Authorization. By purchasing a Membership or any recurring Add-On, you authorize Kre8 Social and its payment processors to automatically charge your payment method on file on each billing date for the then-current fees, plus applicable taxes and any accrued fees, until you cancel in accordance with Sections 11–12. You are responsible for keeping your payment information current. Memberships carry no long-term contract and may be cancelled under Sections 11–12. Paid advertising spend, where applicable, is billed separately and is never included in the Membership fee.
6. Auto-Renewal & Price Changes
Memberships and recurring Add-Ons renew automatically at the end of each billing period unless cancelled beforehand. We may change pricing, plan inclusions, or fees at any time. For active Memberships, we will make reasonable efforts to provide advance notice of a price increase, and any change takes effect on your next billing cycle following notice. Your continued use after the effective date constitutes acceptance of the new pricing. Add-Ons active at the time of a pricing update are honored through your then-current billing cycle.
7. À La Carte Services & Fee Schedule
For clients who prefer individual services outside a Membership, the following rates apply. All digital and print purchases are final and non-refundable, as we cannot verify whether a design has been downloaded, printed, or used. All fees are in U.S. dollars and are subject to change.

8. Add-Ons & Team Seats
Add-Ons may be attached to any active Membership. Recurring Add-Ons bill alongside your Membership; one-time Add-Ons are invoiced upon request and are due before work begins. Additional team members may be added at $50 per member, per month via the Team Seats Add-On. We extend a 1% discount on annual subscriptions. 9. Payment Terms; Late & Failed Payments; Returned Payments

Memberships. Subscription payment is due upon receipt to activate your schedule. If payment is not received within 24 hours, a courtesy reminder is sent and work is paused. If payment is not received within 7 days, the Membership is automatically cancelled unless prior arrangements are made. You may reactivate at any time with no reactivation fee.

Custom Design & Website Projects. A non-refundable deposit of 50% of the total project cost is due upon invoice to reserve your start date. At the project midpoint, the remaining balance is invoiced and due in full upon receipt. Work pauses until payment is received.

Returned Payments. Any returned or failed payment incurs a $35 returned-payment fee plus a $10 processing fee per occurrence. The full balance, including fees, must be paid within 48 hours of notification. We may suspend Services for any past-due balance.
10. Chargebacks
If you believe a charge is in error, contact us first at sales@kre8social.com so we can resolve it. Initiating a chargeback or payment dispute for a valid charge is a breach of these Terms. You agree that our records and these Terms constitute your authorization for all charges. We reserve the right to contest any improper chargeback, recover the disputed amount plus any bank or processor fees and reasonable costs of collection, suspend or terminate your account, and decline future Services.
11. Subscription Refunds & Cancellations
Due to the advanced, forward-scheduled nature of our content and funnel production, no refunds are issued for subscription payments — including cancellations requested immediately after payment. Your content, posting, and lead-generation schedule continues through the remainder of the paid billing cycle; your subscription simply will not renew unless reactivated.
How to Cancel. You may cancel your monthly or annual plan at any time by (a) logging into your account, or (b) emailing sales@kre8social.com at least two (2) business days before your scheduled payment date. Requests received less than two business days before a scheduled payment, after business hours (Mon–Fri, 9 AM–5 PM ET), on weekends, or on federal holidays cannot stop the upcoming charge. Should a refund be insisted upon after a charge has processed, a 50% cancellation fee applies; the remaining 50% is returned to your original payment method per your bank's timeline. No further Deliverables are provided once a cancellation refund is issued.
12. Custom Project Deposits, Refunds & Credits
We do not offer refunds for custom design or website design/redesign projects. If a concern arises after work has begun, we will make every effort to resolve it. As a final resolution, and subject to review, we may offer, at our discretion, (a) a service credit equal to the original payment amount usable toward any Kre8 Social Service, or (b) a partial refund of 50% of your total payment. All requests must be submitted in writing to sales@kre8social.com. Refunds are not available once more than 50% of a project has been completed.
13. Onboarding, Client Responsibilities, Turnaround & À la Carte
To get started, Kre8 Social will request the materials needed to create your brand file and complete your project. These may include headshots, business or brokerage logos, contact information, brand guidelines, property addresses, MLS numbers, offer details, and any other materials relevant to the requested services.

Clients are responsible for providing accurate and complete materials, approvals, account access, and payment in a timely manner. Kre8 Social is not responsible for delays, missed posting or delivery dates, or other impacts resulting from missing or late materials, approvals, access credentials, or payment.

One-Off Services & Add-Ons I À la Carte requests. A minimum of 48-hours notice is required. Standard turnaround is approximately 5-7 business days after all required materials and assets have been received and the client’s brand file is complete. Turnaround times may vary based on project scope and revision requests.
14. Revisions, Approvals & Scope Changes

Clients will have the opportunity to review and approve work throughout the project. Reasonable revisions are included as outlined within the selected service or project scope. Additional, excessive, or repeated revisions may be subject to additional fees.

Requests that fall outside the originally approved scope of work will be billed at $75 per hour, with a two-hour minimum, and may require a revised estimate or agreement before additional work begins.

Upon completion, a "Project Completion Sign-Off" will be emailed to the client. If the sign-off is not returned or revisions are not requested within 7 days, the project will be considered approved and complete, and the project file will be closed.
15. Social Platform Access & Credentials
To publish on your behalf, we require login credentials for each Platform included in your plan. If you prefer not to grant access, we will design and email your completed content for you to publish; the Membership fee is not adjusted for self-publishing. You are responsible for the security of your credentials and for compliance with each Platform's terms. You authorize Kre8 Social to access and act within your accounts solely to perform the Services.
16. Paid Advertising (Meta, Google & Others)
Memberships and Add-Ons do not include paid advertising unless expressly stated. Where paid ad management is engaged, advertising spend is additional and optional, billed separately, and paid directly to the Platform or as otherwise arranged. Campaigns are built to your specified budget. Kre8 Social manages creative, copy, and optimization; ad delivery, approval, performance, and account standing are controlled by the respective ad networks, and we do not guarantee any specific reach, cost, lead volume, or return. You are responsible for the accuracy and legality of claims in advertising you approve.
17. Third-Party Platforms & Tools
The Services rely on third-party Platforms that Kre8 Social does not own or control. This website and Kre8 Social are not affiliated with, endorsed by, or connected to any social media platform, search engine, or third-party tool (including Meta, Instagram, Facebook, TikTok, YouTube, Google, Wix, and Canva). We are not responsible for any Platform's acts, omissions, outages, policy changes, algorithm changes, fee changes, content moderation decisions, or the suspension, restriction, or termination of your Platform accounts. Your use of any Platform is governed by that Platform's own terms.
18. Intellectual Property — Ownership & License of Deliverables
Upon full payment of all applicable fees, Kre8 Social grants you a non-exclusive, worldwide license to use the final Deliverables for your business and marketing purposes. Until payment is received in full, all Deliverables, drafts, concepts, and working files remain the sole property of Kre8 Social. Unless expressly agreed in writing, Kre8 Social retains ownership of all preliminary concepts, source and working files, templates, systems, processes, and any tools or methods developed in performing the Services. You may not resell, sublicense, or redistribute Deliverables as stand-alone design products, or claim authorship of the underlying design system.
19. Client-Provided Materials; Warranties & Indemnity
You represent and warrant that you own or have the necessary rights, licenses, and permissions to all Client Materials you provide, and that our use of them will not infringe any third party's intellectual property, privacy, publicity, or other rights, or violate any law. Should Kre8 Social face any claim (including copyright or trademark infringement) arising from Client Materials, we will notify you in writing, and you are responsible for all resulting costs and legal expenses, including our attorneys' fees, and you will indemnify us as set forth in Section 28.
20. Kre8 Social IP; Website Permitted & Restricted Use
The digital images, transcripts, text, graphics, and content on this website are the copyright of Kre8 Social or used under licenses held by Kre8 Social. Visitors may access, download, and print materials from this website for non-commercial private study or research only. Visitors may not copy, distribute, screenshot, reproduce, sell, or publish any copyrighted material from this website, nor transfer it to any public internet site. For written permission, contact sales@kre8social.com. Kre8 Social actively monitors for violations of this policy.
21. Portfolio & Promotional Rights
Unless you request otherwise in writing, you grant Kre8 Social the right to display deliverables and general, non-confidential results in our portfolio, website, social media, and marketing materials, and to identify you as a client. You may revoke this permission for future use by emailing info@kre8social.com.
22. Confidentiality
Each party may receive non-public information from the other. Both parties agree to use such information only to perform under these Terms and to protect it with reasonable care. This does not apply to information that is public, independently developed, or required to be disclosed by law. Kre8 Social's systems, pricing structures, and processes are our confidential information.
23. Acceptable Use & Client Conduct
You agree not to use the Services to create, promote, or distribute content that is unlawful, fraudulent, defamatory, discriminatory, harassing, infringing, or that violates any Platform's rules or applicable advertising, consumer-protection, fair-housing, or real estate regulations. Kre8 Social may decline or remove any request or content that, in our sole judgment, violates this Section or exposes us to liability, without refund.
24. Communications Consent — Email & SMS
By providing your email address or mobile number, you consent to receive service-related and marketing communications from Kre8 Social. For SMS/text messaging: message frequency varies; message and data rates may apply; reply STOP to opt out and HELP for help; consent is not a condition of purchase. By default, contacts submitted through our website are added to our CRM and newsletter list — if you prefer not to be added, note this before submitting. You may unsubscribe from marketing emails at any time via the unsubscribe link. Where we manage email or SMS campaigns on your behalf, you are responsible for having lawful consent from your own contacts and for compliance with applicable laws (including CAN-SPAM and TCPA).
25. Results Disclaimer / No Guarantee
Our work is designed to enhance brand recognition, consistency, and business presence. Results vary based on your effort, consistency, market conditions, pricing, offering, and other factors beyond our control. Kre8 Social does not guarantee any specific outcomes, rankings, impressions, engagement, lead volume, appointments, sales, or revenue.
26. Disclaimer of Warranties
The Services and all Deliverables are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any result will be achieved. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
27. Limitation of Liability
To the fullest extent permitted by law, Kre8 Social and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Services, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. In all cases, our total aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you actually paid to Kre8 Social for the specific Service giving rise to the claim during the three (3) months immediately preceding the event giving rise to liability. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
28. Indemnification
You agree to defend, indemnify, and hold harmless Kre8 Social and its members, officers, employees, and contractors from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Client Materials; (b) content or advertising you approve; (c) your use of the Services or Deliverables; (d) your violation of these Terms, any law, or any Platform's rules; or (e) your infringement of any third-party right.
29. Termination
You may cancel a Membership as described in Section 11. Kre8 Social may suspend or terminate the Services or your access, with or without notice, for non-payment, chargebacks, breach of these Terms, abusive or unlawful conduct, or any conduct that risks harm to us or others. Upon termination: all outstanding amounts become immediately due; licenses to unpaid Deliverables terminate; and Sections that by their nature should survive (including Sections 9–12, 18–20, 22, 25–28, and 31) survive termination.
30. Force Majeure
Kre8 Social is not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, hurricanes and severe weather, natural disasters, power or internet outages, Platform or vendor failures, labor disputes, cyberattacks, pandemics, or government action.
31. Governing Law; Binding Arbitration; Class-Action Waiver
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration administered under the rules of a recognized arbitration provider, conducted in the county in which Kre8 Social maintains its principal place of business, or by remote/online proceeding. Judgment on the award may be entered in any court of competent jurisdiction. You and Kre8 Social agree that claims will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. Either party may seek injunctive relief in a Florida court to protect intellectual property or confidential information. If any portion of this Section is found unenforceable, the remainder remains in effect, and exclusive venue for any non-arbitrable matter lies in the state or federal courts located in Florida.
32. Changes to These Terms
Our business evolves continually, and we may update these Terms at any time. The version in effect at the time of your use governs that use. Material changes will be reflected by an updated "Last Updated" date, and, where practical, by notice. Your continued use of the Services after changes take effect constitutes acceptance.
33. General Provisions
These Terms, together with any order form or statement of work, are the entire agreement between you and Kre8 Social and supersede prior understandings. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Section headings are for convenience only.
34. E-Gift Cards
E-gift cards are redeemable at Kre8Social.com toward Services not exceeding the remaining balance. Treat your e-gift card as cash; if lost, misplaced, or stolen, it will not be replaced. E-gift cards are valid for one (1) year from the date of purchase, are not exchangeable for cash, and remain the property of the issuer. Please track your balance and expiration date. Use of an e-gift card constitutes acceptance of these Terms.
35. DMCA / Copyright Complaints
We respect intellectual property rights. If you believe content on our website infringes your copyright, email info@kre8social.com with: a description of the work; the location of the material; your contact information; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that your notice is accurate and you are authorized to act. We will respond appropriately, which may include removing the material.

PART II — PRIVACY POLICY
1. Overview
This Privacy Policy explains how Kre8 Social collects, uses, shares, and protects personal information when you use our website and Services. By using the Services, you consent to the practices described here.
2. Information We Collect
Information you provide: name, business name, email, mailing address, telephone/mobile number, business website, social media handles and account access you choose to grant, payment and billing information (processed by our payment providers), documents and materials you upload, and the contents of your communications with us.
Information collected automatically: when you visit our website, we automatically collect the domain and host from which you access the internet, your IP address, browser and operating system, device information, the date and time of access, the referring website, and pages viewed. This is used as anonymous, aggregate data to keep the site functioning and improve it.
Information from third parties: we may receive information from payment processors, analytics providers, advertising Platforms, and social/CRM tools used to deliver the Services.
3. How We Use Information
We use information to: provide, operate, and improve the Services; process payments and manage your account and subscription; communicate with you about your account, projects, and support; send newsletters and marketing (subject to your consent and opt-out rights); create and manage content, campaigns, and lead-generation systems; conduct research and internal and client reporting; prevent fraud and enforce our Terms; and comply with legal obligations.
4. Cookies & Tracking Technologies
Our website (hosted on Wix) and our marketing tools may use cookies, pixels, and similar technologies to operate the site, remember preferences, analyze traffic, and support advertising. You can control cookies through your browser settings; disabling some cookies may affect site functionality. Where required, we present a cookie or consent banner and honor your choices.
5. How We Share Information
We do not sell your personal information. We share it only: (a) with service providers and processors who help us operate (e.g., payment processors, email/SMS providers, analytics, CRM, hosting, advertising Platforms), under confidentiality obligations and only as needed; (b) to comply with law, subpoenas, court orders, or legal process, or to establish or defend legal claims; (c) to investigate or prevent fraud, security issues, or violations of our Terms; and (d) in connection with a merger, acquisition, or sale of assets, in which case client information may be among the transferred assets. Credit card information is never disclosed by Kre8 Social, and we follow the conditions of use established by Visa, Mastercard, Discover, American Express, and PayPal.
6. Third-Party Services & Links
The Services integrate with and link to third-party Platforms with their own privacy practices. We are not responsible for the content or privacy practices of those third parties; we encourage you to review their policies.
7. Email & SMS Marketing
With your consent, we send marketing emails and text messages. Message and data rates may apply; message frequency varies; reply STOP to opt out and HELP for help; consent is not a condition of purchase. You may unsubscribe from emails at any time via the unsubscribe link. Where we manage campaigns on your behalf, you are responsible for having lawful consent from your own contacts.
8. Data Security
We take reasonable administrative and technical measures to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please secure your own Wi-Fi, devices, and passwords, and never share credentials unnecessarily. By working with us, you acknowledge that we are not liable for a compromise of your accounts or devices outside our control.
9. Data Retention
We retain personal information for as long as needed to provide the Services, maintain business and financial records, resolve disputes, and comply with legal obligations, after which we delete or de-identify it.
10. Your Privacy Rights
Depending on your location, you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of marketing or the "sale/share" of personal information (we do not sell). California residents may have rights under the CCPA/CPRA, including the right not to receive discriminatory treatment for exercising those rights. To make a request, email info@kre8social.com; we may need to verify your identity before responding.
11. Children's Privacy
The Services are intended for businesses and adults. We do not knowingly collect personal information from children under 13 (or under 16 where applicable). If you believe a child has provided us information, contact us and we will delete it.
12. Do Not Track
Some browsers offer a "Do Not Track" signal. Because there is no common industry standard, our website may not respond to these signals; we describe our actual practices in this Policy.
13. Service Area
The Services are offered from and directed to the United States, primarily Southwest Florida. If you access the Services from outside the United States, you are responsible for compliance with local laws, and you consent to processing of your information in the United States.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The "Last Updated" date reflects the latest version, and your continued use after changes take effect constitutes acceptance.
